District Management Group, LLC (“we” or the “Company”) provides an online web-based application known as DMSchedules (“Application”) made available at the website www.dmschedules.com (the “Site”) and the products, software and materials in or made available through such Application (including any update, revision, enhancement, new feature and/or the addition thereto) as well as related set-up and training services (together, the “Services”). Our clients are school districts (the “District”). A District will identify and authorize certain employees or representatives to use the Site and Services on the District’s behalf (“You” or “Authorized User”). Only Authorized Users have access to the Site and Services.

This Privacy Policy outlines how we collect, use, disclose and safeguard your information. This Privacy Policy applies only to Personal Information we collect through the Site and Services and does not apply to information we collect off line.

Agreement

By using the Site and/or the Services, you accept and hereby consent to our collection, use, and disclosure of your Personal Information in accordance with the terms of this Privacy Policy.

We may update or modify this Privacy Policy from time to time, including any referenced policies and other documents. If we change the policy in any substantive way, we will use reasonable efforts to notify you (by, for example, sending an email to the account administrator, or in the Product itself).

Your continued use of the Site or the Services after any changes signifies your express consent to any such changes. If you do not agree to such changes, you must immediately stop using the Site and the Services.

  1. Information We Collect. We collect the following types of information from users of the Site:

    a. Personal Information: “Personal Information” is information about you that you or the District provides to us that is personally identifying, such as your name and email address and that is not otherwise publicly available. The legal definition of Personal Information depends on your physical location and may include other types of information. Only the legal definition that applies to your physical location will apply to you under this Privacy Policy.

    We receive Personal Information, such as your name and email address, from the District which identifies you as an Authorized User. We also collect Personal Information from you when you access the Site.

    b. Non-Personal Information. We collect certain information that users do not visibly enter, such as web browser, browsing pattern on the Site and click stream (“Non-Personal Information”). Non-Personal Information allows us to enhance your experience and better support your needs but it is not stored in a manner that is personally identifiable with you.

    Non-Personal Information is collected primarily through the use of “cookies”. A “cookie” is a small file or tool stored on your hard drive containing information that allows us to deliver customized information to you. You may set your browser to notify you of or decline the receipt of cookies but, if your browser is configured to disable cookies, certain features of the Site may not function properly or be available to you.

    We use both "session" and "persistent" cookies on this Site. Session cookies are temporary bits of information that are erased once you exit your web browser or turn off your computer. Persistent cookies are more permanent bits of information that are placed on the hard drive of your computer and stay there unless you delete the cookie. They store information on your computer for a number of reasons, such as helping to determine what areas of the Site you find most valuable. Persistent cookies, such as cookies used in connection with Google Web Analytics, placed on your computer by the Site do not store any personal information.     c. Submissions and Communications; User Content. The Site enables Authorized Users to post their name along with information and comments (“User Content”). All submissions and User Content may be collected by the Company and are viewable by other Authorized Users in your District who have administrative privileges. The Company has no control over the use of User Content by administrators, and User Content is not covered by this Privacy Policy.

  2. How We Use Information. We use your Personal Information to provide services to our client districts, both as aggregate and detailed information and reports. For example, the percentage of time you and your department in aggregate spend on various activities based on your weekly schedule.

    We may use non-identifying and aggregate information to perform statistical analyses to improve the design of our website and provide a better user experience.

    We do not sell or share mailing lists (names and addresses) and e-mail addresses of Authorized Users to third parties.

    We may use your Personal Information to send you important administrative information regarding the Site and Services or changes to our Terms of Use. We may use collected information to enforce our agreements with you, to prevent fraud and other prohibited or illegal activities and for other legally permissible purposes.

  3. Disclosure of Information that We Collect.

    a. Compliance with Law and Fraud Protection: We may disclose any information, including, without limitation, Personal Information, we deem necessary, in our sole discretion and without your prior permission, to comply with any applicable law, regulation, legal process or governmental request. We reserve the right to disclose Personal Information of a user who we believe is in violation of this Privacy Policy of the Site’s Terms of Use or in order to protect or defend our rights or property, even without a subpoena, warrant or other court order.

    b. Sale or Transfer of Information: In the event of a sale, merger, liquidation, dissolution or sale or transfer of substantially all of our assets or the Site, Personal Information and/or other information collected about you from the Site may be sold, assigned or transferred to the party acquiring all or substantially all of the equity and/or our assets or the Site in order to permit the party to continue the operation of the Site. By using the Site and submitting your information to us, you consent to the sale and transfer of your information as described in this paragraph.

    c. Disclosure to District and Third Party Vendors: We disclose your Personal Information to your District in order to report on the percentage of time you and your department in aggregate spend on various activities based on your schedule. We disclose Personal Information to our third party vendors who assist us in operating the Site and providing the Services. These third parties are contractually obligated to maintain the confidentiality of your PII consistent with the terms of this policy and to comply with the applicable data protection laws.

  4. Our Commitment to Data Security. We have put in place appropriate physical, electronic and managerial procedures and accepted technology standards that are intended to safeguard and secure the information collected on or through the Site. Only authorized personnel are provided access to Personal Information and these personnel are required to treat this information as confidential. Our site uses Secure Socket Layer (SSL) to encrypt all information from your web browser to our servers.

  5. How You Can Access or Correct Your Information, Delete your Account, or Opt Out of Use of Your Information. You can access and modify your Personal Information by clicking your log-in name at the top of any page when you are logged in.

    You may request that we delete your account any time by using the “Contact Us” information in this Privacy Policy or available through the Site. Deleting your account will not delete the User Content submitted by you, it will only delete your Personal Information provided by you or the District.

    Although we do not anticipate doing so, if we send you a newsletter or other promotional communication, the communication will contain instructions for how to opt out of receiving similar communications in the future.

  6. Our Commitment to Children's Privacy. Protecting the privacy of children is especially important to us. The Site is not intentionally designed for or directed at children who are age 13 years or younger. We require that only adults use our Site. By using the Site, you hereby represent that you are at least the age of majority or older.

  7. Third-Party Links. The Site may include links to third-party websites. Please be aware that we cannot control and are not responsible for the information collection practices of other websites even if a link appears to a third-party website from the Site. We encourage you to review and understand the privacy policies of these websites before providing any information to or through them.

  8. California Privacy Rights; California Do Not Track Disclosures. If you are a California resident, Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information by us to a third party for the third party's direct marketing purposes. Since we do not make such disclosures, we are exempt from these reporting requirements.

  9. No Rights of Third Parties. This Privacy Policy does not create rights enforceable by third parties.
